Working Time Regulations Opt Out Agreement

I understand that with the effect of the 1998 Working Time Regulations, which became law on 1st October 1998, would Iimit my average working week to a maximum of 48 hours, inclusive of any double time payments, over a 7-day period averaged over 17 weeks.

BardWood Support Services Limited has informed me that should I not wish to work more than 48 hours then I will suffer no detriment nor be treated less favourably than any other employee.

PLEASE READ THE BELOW THREE STATEMENTS AND TICK ONLY ONE BOX

1) - I hereby agree that the provisions of Regulation 4(1) of the Working Time Regulations 1998 should not apply to me. Additionally, if at any time, should I change my mind, I agree that should I wish to revert to the 48-hour maximum as specified in the Working Time Regulations, I will give the company a minimum of one month’s notice, in writing, of cancellation of this agreement in order that they can make the necessary business arrangements to meet operational/customer requirements.


2) - Although I am unlikely to work more than an average 48 hours per week, I wish to register my agreement to have the option to do so. This will allow me the opportunity to work additional hours when I choose. I understand that without this confirmation the Company will be unable to offer me additional work. I therefore agree that the provisions of Regulation 4(l) of the Working Time Regulations 1998 should not apply to me. If at any time I should change my mind, I will give one month’s notice to my Manager of this intention, after which period I understand that only an average of 48 hours per week will be given to me to work.


3) - I do not wish to work anymore than an average of 48 hours per week. I understand that by making this declaration, the Company will not be permitted to allow me to work more than 48 hours per week and that I will only be paid for the hours which I work.
